Terms of Service (Beta Programme)

Welcome to the NetOps Console Beta Programme ("Beta Programme"). These Terms of Service ("Terms") govern your participation in the Beta Programme and your use of our beta software, services, and related documentation (collectively, the "Beta Services").
By accessing or using the Beta Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not participate in the Beta Programme or use the Beta Services.
1. Beta Programme Participation
- Eligibility: Participation is by invitation or application approval and may be subject to specific criteria.
- Beta Nature: You acknowledge that the Beta Services are pre-release versions, may contain bugs, errors, and defects, and may not operate correctly or be fully functional. They are provided "as is" and "as available" without warranties of any kind.
- No Guarantees: We do not guarantee that the Beta Services will become commercially available or that any features tested will be included in a final release.
- Termination: We reserve the right to modify, suspend, or terminate the Beta Programme or your access to the Beta Services at any time, for any reason, without notice or liability. You may also terminate your participation at any time.
2. Licence and Use Restrictions
- Licence Grant: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Beta Services solely for internal evaluation and testing purposes during the Beta Programme term.
- Restrictions: You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Beta Services.
- Modify, adapt, translate, or create derivative works based on the Beta Services.
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Beta Services to any third party.
- Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the Beta Services.
- Use the Beta Services for any commercial purpose, production use, or in any manner that violates applicable laws or regulations.
- Use the Beta Services to store or transmit infringing, libellous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights.
- Attempt to gain unauthorised access to the Beta Services or their related systems or networks.
3. Feedback
- Providing Feedback: As part of the Beta Programme, you may be asked to provide feedback, suggestions, comments, bug reports, or ideas regarding the Beta Services ("Feedback"). Providing Feedback is voluntary but encouraged.
- Use of Feedback: You agree that we are free to use, disclose, reproduce, licence, distribute, and otherwise commercialise any Feedback you provide, without any obligation or compensation to you. You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up licence to use and exploit your Feedback for any purpose.
4. Confidentiality
You acknowledge that the Beta Services, including their features, functionality, performance, and any non-public information disclosed to you as part of the Beta Programme, constitute our confidential information ("Confidential Information"). You agree to maintain the confidentiality of this information and not disclose it to any third party without our prior written consent. This obligation does not apply to information that is publicly known or becomes publicly known through no fault of yours.
5. Intellectual Property
We retain all right, title, and interest in and to the Beta Services and all related intellectual property rights. No rights are granted to you hereunder other than as expressly set forth in these Terms.
6. Disclaimer of Warranties
THE BETA SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BETA SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE BETA SERVICES AT YOUR OWN RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE BETA SERVICES; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE BETA SERVICES; (c) ANY CONTENT OBTAINED FROM THE BETA SERVICES; OR (d) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE BETA SERVICES EXCEED FIFTY U.S. DOLLARS (USD $50).
8. Indemnification
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to your use or misuse of the Beta Services or your breach of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction, e.g., the State of California], without regard to its conflict of law principles.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page or through other communication channels. Your continued participation in the Beta Programme after such changes constitutes your acceptance of the revised Terms.
